1. Scope of Services
BrightSpace Builders LLC provides home renovation, remodeling, and general contracting services. Project specifics, timelines, and deliverables are detailed in individual agreements.

2. Client Responsibilities
Clients must provide accurate information, communicate promptly, and complete payments as agreed. Changes to scope or materials may affect costs and timelines.

3. Intellectual Property Rights
All materials, designs, and branding by BrightSpace Builders LLC are protected. Clients receive non-commercial usage rights; unauthorized use is prohibited.

4. Limitation of Liability
BrightSpace Builders LLC’s liability is limited to the total project fees paid. We are not liable for any indirect, incidental, or consequential damages resulting from project completion, delays, or events outside our control.

5. Force Majeure
BrightSpace Builders LLC is not liable for delays due to external events like natural disasters, supply chain disruptions, government actions, or labor shortages. Project timelines may be adjusted accordingly.

6. Warranty and Disclaimer of Warranties
BrightSpace Builders LLC provides a limited workmanship warranty for one year. This warranty excludes issues from normal wear, misuse, neglect, or unauthorized modifications. Services are provided “as is” with no guaranteed outcomes.

7. Indemnification
Clients agree to indemnify and hold BrightSpace Builders LLC harmless from third-party claims or damages arising from client actions or modifications to completed work.

8. Dispute Resolution
Disputes will first go through mediation. If unresolved, they proceed to binding arbitration under American Arbitration Association (AAA). Clients agree to bear resolution costs as specified in project agreements.

9. Governing Law and Venue
These Terms are governed by New Jersey law. Disputes will be handled in the jurisdiction of New Jersey courts.

10. Modifications to Terms
BrightSpace Builders LLC reserves the right to update these Terms. Ongoing projects are governed by terms agreed upon initially unless both parties consent to changes.

11. Payment and Refund Policy
Payments are due as outlined. Cancellations before project start may qualify for refunds, minus administrative fees; cancellations post-start are prorated, with possible cancellation fees.

12. Client Acceptance
Clients must agree to these Terms of Service before engaging with BrightSpace Builders LLC. Signing or checking a box acknowledges that clients have read, understood, and accepted these Terms.
